Vincent Montagna, who ran hedge-fund Tiburon Partners from 1998 to 2002 before being charged by the SEC for defrauding 70 investors out of $10 million, pled guilty to securities fraud, investment advisor fraud and wire fraud, and who was sentenced to 40 months in jail, is scheduled to start serving his sentence on March 20. The prosecution had been seeking a term of 9 years against Vincent, however his lawyer, none other than Bernie Madoff's defense attorney Ira Sorkin managed to drop the sentence to a little over 3 years. Sorkin it seems has a soft spot for alleged and sentenced Ponzi perpetrators, as the original SEC charge against Montagna was that he schemed to defraud investors by overstating assets, concealing conflicts of interests and diverting clients' money for his own use. Speaking of conflicts of interest, while there had been some recent brief discussions about Ira Sorkin's own conflicts of interests dealing with Bernie Madoff, especially his deceased parents' Nathan and Rosalie Sorkin Madoff accounts, none have yet been uncovered in the Montagna case.While it is unknown if Montagna shares anything else with Madoff aside from a common lawyer, Sorkin declined to comment on whether the 36 year old ex manager ratted out any other Ponziers to the government in exchange for a reduced sentence. And Vincent is not really getting off too easy: he must forfeit $686,000 and property in Pennsylvania and Nevada, and any future income must go to paying the $7.7 million he owes investors.
Sorkin managed to do an impressive job of letting Montagna do much more while on bail than his other notable client who is under perpetual house arrest. Following his arrest, Montagna posted $300,000 bond and remained free, living with his family in Doylestown, PA. While awaiting his sentencing, Montana was given travel waivers and was allowed to fly to Florida, California Hawaii and elsewhere.
Amusingly, beginning November 2006, Montagna started work as a freelance chef for Wolfgang Puck, demonstrating that even convicted white-collar criminals can get jobs. Vincent was in fact expected to cater an Academy Awards dinner before going to jail. While Vincent was originally supposed to report to prison on March 6, Judge Koeltl extended the reporting date to March 20 so the Ponzier could attend his son's fifth birthday party and cook for an Oscar event.

Research the facts of the charges!
Montagna plead GUILTY to "Non-disclosure of material information". Which were related to conflicts of interest. All other charges where dropped.
Montagna DID NOT PLEA GUILTY to securities fraud, investment adviser fraud, or remaining wire fraud.
To add, the charges of Investment Advisor Fraud was an incorrect charge in the case.
those of us in doylestown who know vinnie personally and watched him run a restaurant into the ground while out on bail should have been able to testify at the trial when his lawyer presented him as a real nice guy..the fact of the matter is that he stole wine, had sexual escapades with two employees, taking one of them, named amber, to Caesars in atlantic city while his wife took care of the kids..he is requesting that he serve his sentence close to his family, why? i guess he can still cheat on his wife while in jail, its just going to have to be with men...all of us old employees are real happy that we lost our jobs so that vinnie could have a little fun before he goes away...by the way, he is a terrible chef...vinnie---if you read this, will you personally let us know what you and heidi were doing in the bathroom?

I only met Vince a few times when he would come out of kitchen and speak to customers. It's a shame and unfortunate for the legal situation he is entangled In. As for the food when it was Bmaxwells was almost inedible as for the food at Rare when he got involved to help turn things around it was on it's way to being one of the better restaurants in Doylestown. As for all the negative comments in my opinion Doylestown doesn't like change and this man tried to change things for the better. But what can you expect when the old employees are used to working in a dive bar and restaurant and try to convert it to an elegant establishment. As for the bartenders one particular stands out in my mind was a male with glasses rude comments to women and couldn't make a martini to save his life or open a bottle of wine. Being a neighbor and reading the comments and having known Vin for several years I can't sit back and allow angry employees to attack him by hiding like cowards behind inconspicuous names. Knowing some of his legal situation there is more to it than the articles states

I have lived in Doylestown for many years BMaxwells since the 80s was always a dump with employees who was as bad and old as the building it was housed. The same employees who are initiating the smear campaign of sexual escapades did the same thing with the previous owner of Bmaxwells. I think If you have something to say don't hide. Vin has done a lot of good for people and children he may have made a mistake with his company but you angry people shouldnt smear him even more. From what i know Bmaxwells was being run into the ground long before he came along you would have lost your job even if he wasn't there. At least you got a taste of what a restaurant should be and look like. If he was going to cheat on his wife Im sure he wouldn't do it in front of an entire staff or let anyone know about it.

its a small town and one of the best circulating stories is that the owner of cafe allessio sent his 13 year old son over to get ice from the kitchen and was sent upstairs where the cooler is where he found amber and vinnie snorting some sort of drug off a table, he was rather upset and his father was pretty angry...

I had only been to the restaurant when it was Rare, never when it was Bmaxwells, only because Bmaxwell always looked disgusting so it was never appetizing to me. I tried Rare once and wanted to keep returning. I was told that it was all because of the fine culinary skills Vinnie brought to the establishment. The food was excellent when Vinnie was the chef, probably one of the best in Doylestown and the ambiance was like going to a trendy lounge in Philly. I remember Vinnie, breaking his hump working all night trying to get that place up and running (and that was in between flying around the country cooking for a living trying to support his family). Any new business you never make money for a long time!! He put a lot of time and dedication into Rare, so to hear that he ruined everything, is very unlikely and not factual. I also remember seeing the other guy, Roman I think his name was. Always drunk and treating women like crap. What a degenerate he was. So, I am not surprise the see that his "old employees" are degenerates like him (birds of a feather flock together!!) What I do know about Vinnie from the neighborhood is that the moment he moved to our community, he befriended all he met and welcomed all his friends and neighbors into his home, even during holiday seasons!! He shared his culinary desires with us and always extended his services for any of his friends parties. It is "dirty pool" that "old employees" who couldn't make anything better out of themselves, other that being a line cook (they use to be called "shit or hash slingers" in the army) have to use Vinnie as a scapegoat for the business' managerial problems.
